These general terms and conditions govern accommodation contracts between LIVINPARIS and its customers (hereinafter “Customers” or “Residents”). The French-language version of these terms and conditions shall prevail.
Article 1 – APPLICABLE REGULATIONS
These general terms and conditions form an integral part of the accommodation contract, which is subject to the French Tourism Code and confers no right to remain in the premises or establish a registered address there. Under no circumstances may the Customer rely on the legal provisions governing ordinary residential leases. The Customer acknowledges and undertakes never to declare the premises covered by the accommodation contract as their principal residence, failing which they shall incur liability and the contract shall be automatically terminated.
Article 2 – BOOKING CONDITIONS
An apartment booking is valid only once accepted by LIVINPARIS. The Customer must pay an advance payment to secure the booking. If this payment is not made, LIVINPARIS may, at its discretion, decline to maintain the booking.
This advance payment must be made using a valid credit card issued by a recognised solvent institution, with the card details provided, including the security code on the reverse and the expiry date, or by instant SEPA bank transfer.
Article 3 – PRICES AND PAYMENT TERMS
Prices are stated in euros and include all taxes and charges except tourist tax. They cover only the provision of an apartment. Optional services are not included. Tourist tax per adult per night is excluded.
LIVINPARIS reserves the right to pass on any changes in VAT or tourist tax at the legally applicable rates.
LIVINPARIS accepts only the following credit cards: Visa, Mastercard and American Express. Cash payment is permitted only for transactions totalling less than €1,000 for individuals who are French tax residents, or €15,000 for individuals who are foreign tax residents. The full cost of the stay and any optional services carrying an additional charge must be paid before access to the apartment is granted. The same applies to any extension of the stay. The booking becomes final only once these amounts have been paid in full. Early departure does not entitle the Customer to any refund. Late payment will incur an additional charge of 1.5% per month of delay, starting from the invoice payment due date.
Article 4 – SECURITY DEPOSIT
At check-in and before the keys are handed over, the Customer must provide LIVINPARIS with a security deposit against any damage that may occur in the apartment during the stay. The deposit is set at 10% of the booking amount, subject to a minimum of €500. It must be provided by credit card pre-authorisation. The pre-authorisation will be released within three working days following check-out, provided no damage has been found in the apartment. If any issue is identified during the departure inspection or the house rules have not been respected, the security deposit will be returned within one month, less the cost of repairs or any costs incurred. Where the security deposit is insufficient to cover the damage identified, the Customer undertakes to pay the outstanding balance within 48 hours of notification by LIVINPARIS. After this period, the amount due will accrue interest at 1.5% per month of delay.
Article 5 – ARRIVAL AND DEPARTURE CONDITIONS
LIVINPARIS welcomes the Customer on arrival to ensure that the accommodation contract is completed, payment for the stay and the security deposit are settled, keys, codes and/or access fobs are handed over, and an arrival inspection is carried out. The Customer undertakes to contact LIVINPARIS 30 minutes before arrival on +33 (0)7 87 78 29 13. Check-in is between 3 pm and 10 pm. Check-out is before 11 am. Late arrivals between 8 pm and 10 pm constitute an optional service charged at €30 including tax. No check-in is provided after 10 pm. At the end of the contractual period, LIVINPARIS also attends to collect the keys and inspect the premises. If the Customer leaves without returning the keys, the keys will be deemed lost. If the Customer leaves without a departure inspection, the premises will be presumed to be in the condition in which LIVINPARIS finds them after the Customer’s departure. Once the latest permitted check-out time has been reached, the Customer expressly authorises LIVINPARIS to retake possession of the premises and relinquishes any personal belongings left there, without prejudice to any penalties or damages arising from damage to the premises and the cost of disposing of abandoned belongings.
The Customer acknowledges that a penalty of €300 shall automatically become payable to LIVINPARIS for any key lost or not returned at check-out at the end of the contractual period, and €100 for any access fob lost or not returned at check-out.
Article 6 – CANCELLATION AND NO-SHOW
Any cancellation must be notified to LIVINPARIS in writing and shall take effect only upon receipt. If the Customer cancels the booking, they become liable for compensation equal to the full advance payment made. Any cancellation outside the period stipulated in the booking and/or any no-show (failure to check in) automatically requires the Customer to pay compensation equivalent to the total cost of the stay excluding tax, plus a contractual penalty of 10%. Early departure by the Customer, for any reason whatsoever, shall not entitle them to any refund from LIVINPARIS.
Article 7 – LIVINPARIS SERVICES
Rates include check-in and check-out fees, cleaning and laundry costs on the Customer’s departure, and the provision of household linen (bed linen and towels), toiletries, the specified equipment and a reception service during its opening hours. LIVINPARIS also offers the following paid services: daily housekeeping, daily household linen laundry and personalised services on request. These additional services must be booked by telephone, email or at check-in and are subject to availability. Their cost varies according to the size of the apartment.
Article 8 – RESIDENT’S OBLIGATIONS
The apartment will be made available to the Customer in a well-maintained condition. The Customer undertakes to use the rented premises and their facilities with due care. The Customer must report any issues, missing items or damage within four hours of arrival. The Customer authorises LIVINPARIS in advance to enter the premises to carry out maintenance, repairs, inspections, security work or any emergency measures. Before entering the premises, LIVINPARIS undertakes to contact the Customer using the telephone numbers and/or email addresses provided at check-in.
The Customer undertakes:
– never to exceed the apartment occupancy stated in the contract (where no figure is specified: two people per bedroom plus two people in the living room);
– not to disturb neighbours and, in particular, not to hold any dancing or musical party or any gathering with more guests than the apartment’s capacity;
– not to conduct any commercial, craft or professional activity in the premises, or store furniture there;
– not to smoke in the rented premises or light any candles or other flames;
– not to cause noise disturbances during the day or at night. In the event of a disturbance, the Resident gives LIVINPARIS advance permission to enter the premises and put an end to it, including by requiring everyone to leave if necessary;
– not to place objects likely to block the pipes in washbasins, baths, sinks, toilets or similar facilities, failing which the Customer shall be liable for the costs of restoring those facilities;
– to inform LIVINPARIS immediately of any incident or damage in the rented premises, even if no damage is apparent.
Article 9 – LIABILITY
LIVINPARIS shall not be liable for theft of or damage to personal belongings in the apartments. Nor shall LIVINPARIS be liable if the Resident exceeds the apartment’s occupancy limit; the Resident shall bear all consequences of that breach. If LIVINPARIS cancels the booking for any reason, LIVINPARIS undertakes to make every effort to provide the Customer with equivalent accommodation within its portfolio for the same dates. If such accommodation cannot be offered, LIVINPARIS shall refund the Customer the amounts paid on a pro rata basis for the relevant period.
Article 10 – PENALTIES
The contract shall be terminated automatically, without formalities or delay, if the Customer fails to fulfil any of their obligations or behaves inappropriately in a way likely to disturb other residents of the building. The Customer must leave the premises immediately and shall not be entitled to a refund of the booking amount. If the Customer fails to leave, they shall automatically become liable for an occupancy charge equal to 2.5 times the daily booking rate for each day or part of a day spent in the accommodation. If necessary, they may be evicted with the assistance of the authorities. As a penalty, the security deposit shall automatically be forfeited to LIVINPARIS, without prejudice to any other damages that may be due. Once the contract has been terminated and LIVINPARIS has retaken possession of the premises, the Customer is deemed to have abandoned to LIVINPARIS any belongings still there. If those belongings require professional removal and disposal because of their nature, this shall be carried out entirely at the Customer’s expense. The Customer undertakes to pay that cost upon LIVINPARIS’s first request, in addition to an occupancy charge equal to 2.5 times the daily booking rate until the date of removal. LIVINPARIS may advance the costs where necessary.
Article 11 – GOVERNING LAW AND FINAL PROVISIONS
French law applies. If the Customer wishes to amend any provision of these general terms and conditions, this must be stated in the contract’s special conditions and agreed by LIVINPARIS. If any provision of these general terms and conditions is found to be unlawful, void or unenforceable for any reason, it shall be deemed not to form part of these terms and conditions and shall not affect the validity or enforceability of the remaining provisions.
